Residential Letting Agents have to be registered or applied to be registered with the new Scottish Letting Agent Register from 1st October 2018 if they wish to continue providing letting agency services.

The Scottish Government introduced this aspect of regulation as part of a root and branch review of the private residential letting sector. This included the introduction of the new Private Residential Tenancy in December 2017 which was designed to improve security of tenure for tenants, prevent frequent unfair rent increases and to try to take out some of the complexity that had built up within the sector. It was also designed to outlaw unscrupulous landlords.

The final piece of the private residential jigsaw will now come into place on 1st October 2018 when all residential letting agents will have to be registered. This will help outlaw unsavoury and illegal practices some agents implemented in the past. The Scottish Government has given this regulation some teeth. It will be a criminal offence to continue to deliver residential letting agency services without being registered and publishable by a fine of up to £50,000 or six months imprisonment or both!

This isn't simply a form filling and "tick box" exercise. Anyone within the business involved in delivering the service must be properly trained and hold the necessary qualification.
